Terms of Service

1. Service Description

First Time Media Inc. (together with its representatives, officers, and directors, "Storylines," "we," "us," or "our") is the developer and publisher of the Storylines mobile application(s) and the Storylines website. Storylines was previously known as Firsties. The Services (defined below) allow users to capture, upload, organize, search, comment, like, store, and share media in the form of photos, videos, voice memos, voiceover recordings, and text notes. In addition, the Services provide users with tools to create storylines — chronological personal timelines — and, where applicable, to share them privately with approved followers or publicly with everyone. The Services also provide applications to create products with media, including customized videos and print photo albums. You are solely responsible for obtaining the equipment and telecommunications services needed to access the Services, and all fees associated with their ongoing usage. If you purchase a paid Subscription (defined below), it will automatically renew and continue on a recurring basis for additional periods of the same duration as your initial Subscription Term at the then-current fees, unless and until you cancel your Subscription in accordance with the Cancellation subsection of these Terms.

2. Introduction

These Terms of Service ("Terms of Service," "Terms," or "ToS") govern the relationship between you and Storylines regarding your access to and use of the Storylines mobile application(s) (individually and collectively, the "Storylines App"), Storylines website, content, and any related services (collectively, the "Services"). In this Agreement, the term "Public" refers to content shared with "Everyone" within the app, based on the visibility settings selected by the user. When you use or access our Services in any capacity, you represent that you are at least 13 years old (or at least 16, if you reside in the EU) and that you understand and agree to these Terms. If you are under the age of 18, you agree that you have obtained permission from your parent or guardian to use our Services. Our collection and use of personal information in connection with the Services is described in our Storylines Privacy Policy, which is incorporated by reference into these Terms. We may amend these Terms by posting an amended version on our website or in the supplemental terms of the applicable Services. The amended version will be effective immediately when posted. By continuing to access or use our Services after we post an amended version, you confirm your agreement to these Terms, as amended. If you do not agree with any of the changes, you must immediately stop accessing our Services. You hereby represent and warrant to Storylines that: (i) you have the legal right and authority to enter into these Terms; (ii) these Terms form a binding legal obligation on your behalf; and (iii) you have the legal right and authority to perform your obligations under these Terms and to grant the rights and licenses described herein. By installing, using, or otherwise accessing our Services, you confirm your agreement to be bound by these Terms.

3. Limited License

License Grant Subject to your agreement and continued compliance with these Terms, we grant you a non-exclusive, non-transferable, non-sublicensable, revocable limited license to: (i) download and install the Storylines App on your mobile device and operate it solely for the purpose of using and accessing the Services as intended; and (ii) access and use our Services for your own personal (i.e., non-commercial) purposes. You agree not to use our Services for any other purpose and to comply with all applicable laws when accessing or using the Services. Restrictions You specifically agree to the following restrictions:
  • If you are under the age of 18, or under the age of legal majority in your jurisdiction, you may not access or use our Services without permission from your parent or legal guardian. You may not use our Services under the age of consent (or under 16 if you reside in the EU).
  • If you have been previously banned from accessing our Services, you are prohibited from re-accessing the Services.
  • You are prohibited from creating an Account on someone else's behalf.
  • You are prohibited from creating an Account using inaccurate or false information.
  • You are prohibited from renting, selling, gifting, or giving away your Account or Account-related information.
  • You are prohibited from selling or transferring prizes or rewards obtained in connection with the Services.
You further agree that under no circumstance will you:
  • Engage in acts that are inappropriate and/or in conflict with the spirit or intent of the Services or these Terms.
  • Attempt to gain unauthorized access to, circumvent, modify, disrupt, overburden, or otherwise impair any aspect of our Services or related technology, devices, systems, or networks.
  • Engage in unlawful, abusive, threatening, obscene, defamatory, libelous, harassing, hateful, violent, racist, or otherwise objectionable or offensive acts, whether by posting and/or transmitting such information through our Services or by any other means.
  • Use our Services to post, supply, or make available any material or information that infringes on any copyright, trademark, patent, trade secret, right of privacy, right of publicity, or any other right of a person or entity.
  • Use our Services to post, display, or transmit any person's or entity's private information without that person's or entity's prior consent.
  • Copy or reproduce, translate, reverse engineer, derive source code from, modify, disassemble, decompile, or create derivative works based on or related to the Services.
  • Scrape, harvest, or extract data, content, or information from the Services using automated agents or scripts.
  • Impersonate another person, including any other user or any Storylines employee.
  • Use our Services to violate any applicable law or regulation.
Account Access and Responsibility When you access or use the Services, you create an account with us ("Account"). You are responsible for all use of the Services and activity related to your Account, including all transactions and payments. You agree to maintain accurate, complete, and up-to-date information in your Account. It is your sole responsibility to maintain the confidentiality and accuracy of your login information. If you learn or suspect that your Account has been compromised, please contact us immediately. Suspension and Termination Without limiting any other remedies, we may suspend, terminate, delete, limit, or modify Accounts or access to the Services, with or without notice, if we suspect or determine, in our sole discretion, that you have failed to comply with any of these Terms or have otherwise engaged in illegal activity or improper use of our Services. We are not responsible for any losses incurred as a result. We reserve the right to modify or stop offering the Services at any time. If we stop offering the Services, your license will automatically terminate and you will have 30 days to download your User Content. We reserve the right to terminate any free Account that has had no login activity for 1 year or more. Upon termination: (1) all rights and licenses granted to you will terminate; (2) you will immediately cease all use of the Services; (3) you will delete the Storylines App; and (4) Storylines will provide 30 days from the effective date of termination to download your User Content, after which Storylines may delete your Account and User Content.

4. Ownership

Storylines' Rights The Services and all related intellectual property rights are and shall remain the property of Storylines. The "Services" include, without limitation, the Storylines App, software, the Storylines website, titles, characters, animations, art, content, audio sounds and effects, musical compositions, visual effects, methods of operation, documentation, moral rights, and Virtual Items. Neither these Terms nor your use of the Services convey or grant to you any rights in or related to the Services, except for the limited license granted above. You acknowledge and agree that you will have no ownership or other property interest in any Account created in connection with the Services. All interest in and rights to any Account are owned in perpetuity by and solely for the benefit of Storylines.

5. User Content

Your Rights and Ownership We offer you the ability to upload, publish, transmit, or otherwise make available to us photos, videos, voice memos, voiceover recordings, audio recordings, materials, data, information, content, and communications using the Services ("User Content"). Your User Content is your property and you retain all rights to it, subject to the limited rights you grant Storylines in these Terms. You retain full copyright and any other rights you already hold in User Content which you upload, submit, publish, post, store, transmit, or display on or through the Services. Storylines obtains no right, title, or interest from you in or to any User Content beyond the limited license granted in these Terms. License to Storylines For the purpose of sharing User Content with people you choose to receive it ("Recipients"), and for providing the Services, you grant Storylines and its third-party providers a non-exclusive, royalty-free, and fully sublicensable right to use, copy, store, reproduce, distribute, and display your User Content throughout the world in any form, software, or technology of any kind. Storylines will not publish or display your User Content outside of your Recipients, except as permitted under Section 6 (Public Storylines) below.
Voice Memos and Voiceover Recordings The Services allow you to record and attach voice memos and voiceover narration to your storylines. By uploading or recording voice content through the Services: you retain full ownership of your voice recordings; you grant Storylines the same limited license described above to store and deliver your voice content as part of your storylines; voice recordings are processed and stored solely for the purpose of delivering your storylines to your Recipients; and Storylines does not use your voice recordings to train AI models or for any purpose beyond delivering the Services. If your storyline is set to Public, your voice memos and voiceover recordings will be accessible to any viewer of that storyline. Please review Section 6 (Public Storylines) carefully before publishing voice content.
Your Responsibilities for User Content As a user, you are personally and solely responsible for all of your User Content. You represent, warrant, and affirm that your User Content is accurate, does not violate any applicable laws or rights of others, that you have the appropriate permissions and consents from any third parties whose information or intellectual property is comprised in your User Content, and that your User Content is free of malware, viruses, and any malicious code. You agree not to upload and/or transmit any User Content that is unlawful, tortious, defamatory, libelous, obscene, threatening, harassing, abusive, violent, hateful, racist, or otherwise objectionable or inappropriate. We may, but are not obligated to, review, monitor, reject, deny, or remove User Content, at our sole discretion, at any time, and for any reason, without notice to you.

6. Public Storylines

Visibility Settings Storylines offers two visibility settings for your storylines:
  • Followers Only (default): only approved followers you have invited can view the storyline. If you have not invited any followers, the storyline is effectively private — no one else can access it.
  • Public: the storyline is accessible to any person with a link and may be discoverable by search engines, social media preview tools, web crawlers, and other automated systems.
Making a storyline Public is always a deliberate, opt-in action. The default setting for every new storyline is Followers Only. Effect of Making a Storyline Public When you set a storyline to Public, you acknowledge and agree that:
  • Any person anywhere in the world — including people you do not know — may view, screenshot, download, share, or embed the content of that storyline.
  • Search engines, social media platforms, and other third-party services may index, cache, or display your public content in ways outside our control.
  • We cannot guarantee that content once made public can be fully removed from all third-party caches or indexes, even after you change the storyline back to Followers Only or delete it.
  • Metadata embedded in your photos, videos, or voice recordings — including location data (GPS coordinates), timestamps, and device information — may be visible to viewers. You are responsible for reviewing and removing sensitive metadata before publishing.
License Expansion for Public Storylines When you set a storyline to Public, you grant Storylines and its service providers the additional right to make that storyline's User Content accessible to the general public through the Services. This expanded license remains in effect until you change the storyline back to Followers Only or delete it; however, third-party caches and indexes may retain copies beyond that point. Your Responsibility for Public Content By making a storyline Public, you represent and warrant that: you have the legal right to publish all photos, videos, voice memos, voiceover recordings, and other content included in that storyline; you have obtained any necessary consents from individuals who appear in, are identified by, or are otherwise associated with the content; and the content does not infringe any third-party intellectual property rights, privacy rights, or any applicable law. You are solely responsible for all content you choose to make publicly accessible through the Platform. Storylines is not liable for any consequences arising from your decision to make a storyline Public, including any exposure, misuse, or redistribution of that content by third parties. Children's Content in Public Storylines Storylines does not permit making "Family" or "Child" category storylines Public. If you include content depicting a minor in a Public storyline: you, as the account holder, are solely and exclusively responsible for any decision to make such content publicly accessible; you represent and warrant that you are the parent or legal guardian of any minor who appears in public content, or that you have obtained explicit consent from that minor's parent or legal guardian prior to publishing; and you acknowledge that publicly accessible content depicting or identifying a minor may be viewed, saved, or redistributed by unknown third parties. Storylines reserves the right to remove any public content that we determine, in our sole discretion, to depict minors in a manner that raises safety or privacy concerns, with or without prior notice. Follower Relationships The Followers Only setting limits your storyline to approved followers. You control who follows you and may remove followers or change your storyline's visibility at any time from within the App. Follower lists and related relationship data are stored as part of your account and deleted upon account closure in accordance with our Privacy Policy.

7. Service Providers

Storylines may provide you with the ability to access through the Services certain websites, technology, products, or services developed, provided, or maintained by third-party service providers ("Third-Party Services"). Third-Party Services may integrate with, pull User Content from, or add User Content to the Services. Any Third-Party Services made accessible by Storylines are provided on an "as-is" and "as available" basis without warranty of any kind. You acknowledge that Storylines does not own, control, or endorse any Third-Party Services; Third-Party Services are provided solely as a convenience; and Third-Party Services may be subject to their own terms and conditions. Storylines shall have no liability for any Third-Party Services and disclaims all liabilities arising from or related to them. One of the Third-Party Services accessible through the Services is a service that automatically compiles animated personalized videos using your User Content. This service is available for an additional fee. Storylines may, in its own discretion, create one or more surprise videos using your User Content (each a "Surprise Video") at no cost to you. By uploading User Content to the Services, you accept that you may receive Surprise Videos from time to time.

8. Virtual Items and Purchase Terms

Any time you purchase virtual currency, virtual in-app items, and any other premium goods or services in connection with our Services (collectively, "Virtual Items") with real currency, Storylines grants you a limited, personal, non-transferable, non-sublicensable, revocable license to use such Virtual Items. Virtual Items do not represent a property interest of any kind and have no value in real currency. Storylines reserves the right to change the purchase price for Virtual Items at any time. Virtual Items are not returnable, exchangeable, or refundable.

9. Storage

As part of our basic plan, we offer up to 0.5GB of free storage. UNDER OUR BASIC (NO-COST) PLAN, UP TO 0.5GB OF YOUR USER CONTENT WILL BE STORED FOR A PERIOD OF 1 YEAR FROM THE LAST DATE THAT YOU LOGGED INTO YOUR ACCOUNT. IF THERE HAS BEEN NO ACTIVITY FOR 1 YEAR, WE WILL DELETE ALL CONTENT PROMPTLY AFTER EXPIRATION OF THAT PERIOD. You can prevent deletion by logging into your Account at least once a year. As part of our premium plan, we offer 200GB of storage, which includes photos, videos, voice memos, and voiceover recordings. If at any point you are using more storage than permitted by your plan, you will have 14 days to take action to preserve your User Content. If you continue to exceed your storage limit after that period, we may delete as much of your User Content (starting with the oldest) as necessary to reduce your storage to the permitted allowance. Once User Content is deleted, it cannot be recovered.

10. Term and Subscription

Certain parts of the Services may be subject to payments now and in the future ("Subscription Services"). We currently offer three paid Subscription Plans: (i) a monthly recurring subscription, (ii) a semi-annual recurring subscription, and (iii) an annual recurring subscription. To sign up, you must visit the applicable app store. If you choose to cancel your paid Subscription, you will need to do so via the applicable app store. A paid Subscription will continue for the length of your selected Subscription Term. After your initial Subscription Term, and again after any subsequent renewal, your Subscription will automatically renew at Storylines' then-current price for such Subscription Plan, unless and until you cancel. You must cancel your Subscription before it renews in order to avoid billing of the next period's Subscription fee. Changes in Fees We may change the fees and charges, or add new fees and charges, at any time. We will notify you by email at least 30 calendar days in advance of any change that affects the amount you are charged. Cancellation You may delete your free Account at any time in the Storylines App. You may cancel your paid Subscription at any time via the app store in which you obtained the Storylines App. Cancellation is effective at the end of the applicable billing period. Please note that if you purchase a Subscription through the Apple iTunes Store, you must cancel automatic renewal by selecting "Manage App Subscriptions" in your Apple account settings.

11. Updates to Our Services

You understand that our Services are evolving. Storylines may require that you accept updates to our Services and may modify or discontinue features at any time.

12. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS FOR YOUR USE, WITH NO WARRANTIES OF ANY KIND. STORYLINES AND ITS LICENSORS EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES AND REPRESENTATIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. STORYLINES DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

13. Limitation of Liability and Indemnification

Limitation of Liability STORYLINES WILL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR OTHER SIMILAR DAMAGES, INCLUDING LOSS OF REVENUES, LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING IN ANY WAY TO THESE TERMS OR OUR SERVICES. STORYLINES WILL NOT BE LIABLE TO YOU FOR MORE THAN THE GREATER OF (I) $100, AND (II) THE AMOUNT YOU HAVE PAID TO STORYLINES IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE DATE ON WHICH YOU FIRST ASSERT A CLAIM. Indemnification You agree to indemnify, save, and hold Storylines, its officers, directors, contractors, employees, agents, third-party suppliers, licensors, and partners harmless from any and all claims, losses, damages, and liabilities, including legal fees and expenses, arising out of or relating to: (i) your use or misuse of our Services; (ii) any breach or violation of these Terms; (iii) your User Content, including any User Content you make publicly accessible; (iv) any breach of the representations, warranties, and covenants made by you herein; or (v) your decision to make a storyline Public, including any claims arising from content depicting minors that you chose to publish.

14. Dispute Resolution and Governing Law

Governing Law The laws of the State of Florida govern these Terms and any matters related to these Terms, without regard to any conflicts of laws principles. Informal Dispute Resolution Before initiating any arbitration or court proceeding, you must first: (1) review our Help/FAQ section inside the Storylines App; and (2) if unresolved, email us at legal@storylines.media describing the specific issue. Our customer support team will work with you to resolve the matter. Venue Any party bringing a legal action arising out of or relating to these Terms shall bring the action only in the state or federal courts located in Miami, Florida. Each party consents and submits to the exclusive jurisdiction and venue of those courts.

15. General Provisions

Severability If any portion of these Terms is found unlawful or unenforceable, that provision will be ineffective only to the extent of such finding, without affecting the remaining provisions of these Terms. Independent Contractors The parties are independent contractors, not agents, employees, or employers of the other, or joint venturers. App Store The Storylines App may be obtained through a third-party distribution platform (e.g., Google Play Store or Apple's App Store) ("App Store") and is to be used solely on a mobile device owned or controlled by you. You agree to comply with all applicable third-party terms of the applicable App Store when using the Storylines App. Assignment Storylines may assign or delegate these Terms and its obligations at any time with or without your approval. You may not assign these Terms without Storylines' prior written approval. Force Majeure We will not be liable for any delay or failure to perform resulting from causes outside of our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fires, floods, accidents, or strikes. Claims of Copyright Infringement If you believe your copyright-protected work has been posted on the Services in a way that constitutes copyright infringement, please contact our DMCA agent with a notice containing: (i) details sufficient to identify and locate the allegedly infringing material; (ii) your name, address, telephone number, and email address; (iii) a statement of good faith belief that the use is not authorized; (iv) a statement under penalty of perjury that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner; and (v) your physical or electronic signature. Storylines enforces a policy of terminating the Accounts of repeat infringers. Entire Agreement These Terms, including any additional policies and documents referenced herein, are the entire agreement between you and Storylines and supersede all prior understandings. Notices We may give notice to you via: (i) postings on the Services; (ii) email, telephone, or text message to any address or phone number connected with your Account; or (iii) written communication sent by mail. Addendum. Supplemental Terms for Apple Inc.

Notwithstanding anything set forth above, with respect to the Storylines App accessed through or downloaded from Apple's App Store, the following additional terms apply:
  1. Acknowledgement: These Terms are between you and Storylines, not Apple. Apple is not responsible for the App or its content.
  2. Scope of License: You will only use the App on an Apple-branded product running iOS, as permitted by the Apple App Store Terms of Service.
  3. Maintenance and Support: Apple has no obligation to provide maintenance or support for the App.
  4. Warranty: Storylines is solely responsible for product warranties. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple for a refund of the purchase price.
  5. Product Claims: Storylines, not Apple, is responsible for addressing any claims relating to the App, including product liability claims and regulatory compliance claims.
  6. Intellectual Property: Storylines, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any third-party intellectual property infringement claim.
  7. Legal Compliance: You represent and warrant that you are not located in a U.S.-embargoed country and are not listed on any U.S. Government list of prohibited or restricted parties.
  8. Third-Party Beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms as related to your license of the App, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
